Cancellation Policy & Procedures
Purpose
The purpose of this policy is to establish clear guidelines in the event of cancellation of registration and courses before the end of the training programme. This policy delineates the necessary terms, conditions, and approval processes.
Consumer Protection Act (CPA)
According to the CPA, “service” refers to lectures, tutoring, and mentoring, while “goods” refers to study materials, textbooks, notes, software, and information on CDs, DVDs, and videos that LEDISA Academy provides to students. Within the realm of education, the end-user, according to CPA, refers to a student who is enrolled for formal and non-formal qualifications with the education institution and with whom the institution has a contractual relationship.
The CPA does not apply in the following circumstances:
- When the state receives promotions or supplies of goods or services, the government is not considered a consumer under the Consumer Protection Act.
- When a promotional competition awards a prize and provides goods or services at no cost or to a limited extent.
- Where services are rendered in terms of an employment contract
General Terms and Conditions
- The student enters into a contractual relationship upon acceptance of all terms and conditions outlined on our website, promotional material, and enrollment form.
- Enrollment completion signifies acceptance of all terms and conditions.
- The student is legally bound by the agreement.
- The contract is with the student, who will benefit from the training services and materials, regardless of who pays the fees (e.g., a parent, guardian, sponsor, funder, or any other third party).
- Tuition rights are not transferable.
- Senior management must approve any transfers from one class to another or from one mode of delivery to another.
- Students are responsible for registering for the correct course and adhering to the most current and correct entrance criteria. LEDISA Academy will not accept students who do not adhere to the entrance requirements for the courses they registered for. LEDISA Academy will cancel the registration of students who do not meet the entrance criteria for their chosen courses.
- When an outside funder sponsors a student’s course (e.g., a learnership), it is the funders’ responsibility to ensure that the students meet the entrance criteria. Should LEDISA Academy be required to cancel the students’ registration because they are not eligible for the course, the funder will be responsible for any cancellation fees.
Cancellation and Exchange of Studies
If a student withdraws from their studies for any reason, they are still fully liable for all fees and other charges, and the cancellation and refund policy will apply.
The student’s failure to make progress with his or her studies or to complete a course for whatever reason shall in no way entitle him or her to a reduction in fees or a refund on fees paid in advance, nor will it absolve him or her of full liability for outstanding fees and other charges.
Cancellation for Online or Correspondence Training:
Within two weeks of registration, students may request the cancellation of course units, the exchange of course units, or the cancellation of a study program. Only if LEDISA Academy has not yet dispatched any study materials or provided a user code and password for access to the study center will we honor these requests. The following conditions apply:
- Cancellation after Material Distribution: If a request for cancellation is received after study materials have been sent or after a user code and password have been assigned and dispatched, no cancellation of registration or studies will be granted.
- Exchange of Courses: If a request to exchange courses is made within two weeks of registration and before any study materials or access to the study center have been provided, a course change fee amounting to 15% of the current study costs will be imposed. The student must also cover the full cost of the new course units, courses, or study programs, including the applicable registration fee for the new study program.
- Late Cancellation: Requests for cancellation received after two weeks from the date of registration or after the student has accessed study materials using their login credentials will not be considered. We will treat such instances as study discontinuations and issue no refund of fees, regardless of the provided reason.
- Cancellations and Exchanges Authority: The management of LEDISA Academy is solely responsible for the application and approval of any course cancellations or exchanges. All decisions made in this regard will be final.
Cancellation for In-Person Training
A cancellation fee of 25% of the course fee will apply if a student cancels their registration for in-person training less than 10 days before the course commencement date.
- No-Show for In-Person Training: In the event that a student does not show up for scheduled in-person training, they will be responsible for paying the full course fee.
- Cancellation with Sufficient Notice: Students can transfer their registration to the next available in-person training event if they cancel their in-person training registration more than 10 days before the course commencement date.
- No subsequent in-person training event available. If there is no subsequent in-person training event available, we will charge a cancellation fee equal to 10% of the course fee. The student will receive a refund for the remaining balance of the course fee.
- Exceptional Circumstances: If the student’s death or hospitalization prevents them from starting their studies, there won’t be a cancellation fee. Similarly, if a third party is unable to honor the registration due to the student’s death or hospitalization, there will be no cancellation fee.
Termination of Studies
Under the following conditions, the training institution reserves the right to cancel the registration and terminate the agreement with immediate effect, without any obligation to refund any fees paid by the learner:
- Misconduct or Disciplinary Issues: If the learner engages in behaviour that is unlawful, violates the institution’s code of conduct, disrupts the learning environment, or poses a threat to the safety and well-being of other students, staff, or faculty.
- Academic Dishonesty: If the learner is found guilty of plagiarism, cheating on examinations, or any other form of academic dishonesty.
- Falsification of Information: This occurs when a learner provides false, misleading, or incomplete information during the application process or fails to update the institution on significant changes to their personal information that could affect their enrollment status.
- Violation of Specific Course or Programme Rules: If the learner violates specific rules set for particular courses or programmes, especially those requiring confidentiality or the handling of sensitive material.
- Improper Use of Technology: If the learner misuses institution-provided technology resources or accesses unauthorized areas of the institution’s IT infrastructure.
- Non-compliance with Public Health Directives: If the learner fails to comply with health and safety regulations mandated by the institution, especially in scenarios like pandemics or outbreaks that pose health risks to the community.
- Violation of Licensing Agreements: If the learner uses licensed software or other digital resources provided by the institution in ways that violate the licensing agreements.
- Non-compliance with Payment Terms: If the learner fails to comply with the financial obligations as specified in any signed agreement or fails to make timely payments as agreed upon.
- Obligation to Pay Despite Dissatisfaction: In the event that a student is dissatisfied with the institution, its services, or any circumstances arising during their course of study, even in instances where the institution may be at fault, the student must fulfill all financial obligations and make payments as agreed upon in their registration contract. Should the student withhold any portion of the payment due to dissatisfaction, the institution reserves the right to cancel the registration immediately. The student will not receive any refund for the fees they have paid in such cases.
- Unauthorized Distribution of Materials: This occurs when a learner distributes, shares, or otherwise makes available any of the learning materials provided by the training institution to any third party without the training institution’s prior written consent.
- Resale of Learning Materials: If the learner sells, trades, or in any manner monetizes the learning materials provided by the training institution.
- Misuse of Learning Materials: If the learner uses the learning materials provided to establish their own training institution or for any commercial purposes not expressly authorized by the training institution.
- Unauthorized Account Sharing: If the learner shares their username and password, allowing unauthorized access to the training institution’s online study centre.
In the event of such cancellation, the training institution reserves the right to claim damages from the learner for any losses suffered due to the breach of these terms. This includes, but is not limited to, lost revenue, legal costs, and other expenses incurred by the training institution.
Entire Agreement
These terms of use, together with our Privacy Policy, constitutes the entire agreement between the parties relating to the website and all related activities. These terms of use shall not be modified except in writing signed by both parties or by a new posting of these terms of use issued by LEDISA Academy.
